SMS Notification Service – Terms and Conditions

1. Definitions
   1. In these Terms and Conditions (“Terms”), unless the context otherwise requires:
      • “Company” means Wilhelmsen Ship Management (WSM);
      • “Service” means the SMS notification service in Emergency Log module in WSM App;
      • “User” means any individual or entity receiving SMS notifications;
      • “Mobile Number” means the telephone number provided by the User;
2. Application of Terms
   1. These Terms shall govern the provision and use of the Service.
   2. By using the Service, the User shall be deemed to have accepted and agreed to be bound by these Terms.
   3. These Terms shall prevail unless otherwise agreed in writing by the Company.
3. Provision of Service
   1. The Company shall provide the Service for the purpose of delivering notifications, alerts, and other relevant communications to the User via SMS.
   2. The Company reserves the right to modify, suspend, or discontinue the Service, in whole or in part, at its sole discretion without prior notice.
4. User Obligations
   1. The User shall ensure that the Mobile Number provided is valid, accurate, and maintained at all times.
   2. The User warrants that it has the necessary consent and authority to provide the Mobile Number for the purposes of receiving SMS notifications.
   3. The User shall promptly notify the Company of any changes to the Mobile Number.
5. Consent to Receive SMS
   1. The User hereby consents to receive SMS notifications from the Company for the purposes of the Service.
   2. Such notifications may include, but are not limited to, emergency alerts, reminders, and service-related communications.
6. Charges
   1. The Company shall not charge the User for the Service unless otherwise stated.
7. Service Availability
   1. The Service is provided on an 'as is' and 'as available' basis.
   2. The Company does not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
   3. The Company shall not be liable for any delay, failure, or non-delivery of SMS messages due to causes beyond its reasonable control, including but not limited to network failures or third-party service provider issues.
8. Data Protection
   1. The Company shall process personal data in accordance with Data Protection Policy.
   2. The Mobile Number shall be used solely for the provision of the Service and shall not be disclosed to third parties except where required for the delivery of the Service or by law.
9. Variation
   1. The Company reserves the right to amend these Terms at any time.
   2. Any such amendments shall take effect upon publication or communication to the User.
